Embezzlement will be charged as a felony, a misdemeanor, or the defendant may face federal charges. The severity of the offense will depend on the amount taken. Illinois state cases will be charged as a Class A misdemeanor if the taken property’s value was $500 or less. A Class 3 felony will be charged if the property’s value ranged from $500 – $10,000. Amounts ranging from $10,000 – $100,000 will be charged as a Class 2 felony while cases ranging from $100,000 – $500,000 will be Class 1 felony. Cases between $500,000 and $1 million will be a Class 1 felony not eligible for probation while a Class X charge will be brought for cases in excess of $1 million.
A defendant will enter a not guilty plea after an Indictment has been issued by the grand jury in either state or federal court. If the prosecution is relying on evidence which was seized from your personal records, in violation of your Fourth Amendment rights, then it is important that your attorney file to exclude such evidence from Court.
