The Trauma of a Personal Injury

Virtually no one is ever really prepared for the trauma of a personal injury. Following an accident caused by the negligence of another person or entity, you must deal with:

  • Obtaining treatment for your injuries;
  • Facing mountains of medical expenses;
  • Perhaps being out of work and unable to pay normal monthly expenses;
  • Having to deal with insurance companies who virtually never want to pay what your claim is worth;
  • Filling out paperwork, and
  • Much, much more.

Unfortunately, many victims of a personal injury can make mistakes, early on, that jeopardize their legal right to financial compensation later. Yet when you have a qualified accident lawyer in your corner, all these mistakes can be avoided, and you can rest easy in knowing you have someone fighting for you. Time is always of the essence in a personal injury claim, meaning you have a very limited amount of time to file your personal injury or wrongful death claim. You also benefit when your attorney has ample time to collect evidence and craft a strong legal case on your behalf. Michael J. Brennan Injury and Accident Lawyers can help you with any of the following types of accidents:

  • Slip and Fall AccidentsNo one ever expects to suffer an injury when they walk into a grocery store to shop for groceries, go into a department store or big box store to shop, go into a restaurant to eat or are simply walking on a sidewalk or going up or downstairs. Yet slip and fall accidents are much more common than many people realize. The owner of a property is liable for any known hazards on the property. This means that if you walk into a grocery store and step into a soda that was just spilled by a toddler, should you fall and sustain injuries, the grocery store might not be liable simply because employees had not had time to see there was a spill and take actions to remedy the slippery floor. If, on the other hand, the spill had been there for thirty minutes, with more than one employee walking by and failing to take action, then the owner of the store could be held liable for the injuries. If a business in Illinois is open to the public, it has an obligation to ensure the locations are kept reasonably safe, however, not all businesses take adequate reasonable care, which can result in a slip and fall accident with injuries.
  • Large Commercial Truck AccidentsLarge commercial truck accidents generally cause death or severe injury due to the sheer size of the truck—80,000 pounds when loaded. A passenger vehicle, on the other hand, might weigh in the neighborhood of 3,000 pounds. A large commercial truck has the added problems of having certain “blind spots,” and having a very difficult time coming to a sudden stop. Truck accidents are more complex than auto accidents for the reasons listed above as well as due to the fact that there can be more than one liable party. The driver of the truck could be at fault, whether due to overly fatigued driving, distracted driving, drunk or drugged driving, or careless or negligent driving. The trucking company could be held liable if they failed to conduct a thorough background check on the driver, failed to ensure the driver was properly trained or were aware the driver was exceeding allowable hours. The loading company could be held liable if shifting cargo caused the accident, the maintenance company could be held liable if poor maintenance caused the accident, or the truck manufacturer could be held liable for a defective truck part.
  • Automobile AccidentsThere are as many as 6 million automobile accidents in the United States each and every year. Of course, not every one of these accidents is serious—some are no more than a parking lot bump-in. Others, however, leave serious injuries in their wake; injuries that can take months, years, or even a lifetime to overcome. The medical expenses and lost wages resulting from an auto accident can seem overwhelming to most of those facing these issues.
  • Wrongful Death AccidentsWhen the victim of a personal injury claim dies, the case becomes a wrongful death claim. The loved ones of the deceased may be able to file a wrongful death claim to recover expenses related to the funeral, medical expenses prior to the death, lost future wages if the deceased was the primary breadwinner, loss of companionship, loss of guidance and care for the children of the deceased, and emotional trauma experienced by the loved ones of the deceased.
  • Traumatic Brain InjuriesThere are as many as 425,000 traumatic brain injuries each and every year, with a large percentage of these being attributed to the negligence of another person or entity. Many of those who suffer a traumatic brain injury will face a lifetime of disability, and a full two-thirds of those with serious disabilities will never work again.
  • Bicycle, Motorcycle, and Pedestrian AccidentsThose involved in a bicycle, motorcycle, or pedestrian accident are likely to be left with severe injuries. Any time a vehicle strikes an unprotected motorcyclist, bicyclist, or pedestrian, the injured person may suffer years—or a lifetime—of medical treatments, rehabilitative therapies, and could be unable to return to work and make a living because of the extent of their injuries. It is vitally important that those injured in these accidents have strong legal counsel to ensure they receive a fair settlement.
  • Burn InjuriesBurn injuries can occur from a truck or automobile accident, a workplace accident, a construction accident, or other types of accidents. Burn injuries not only cause serious medical complications but can also result in disfigurement, which causes emotional and psychological trauma. Those with serious burn injuries may not be able to return to work and make a living and may suffer significant disabilities for the remainder of their life.
  • Dog Bite InjuriesJust as the owner of a property is responsible for a slip and fall accident if he or she failed to take proper precautions, so the owner of a dog in the state of Illinois is responsible if their dog bites a person, unprovoked. Children are particularly vulnerable to dog bites, as their face is closer to the dog’s mouth, and disfigurement can result from the bite.
  • Construction AccidentsConstruction workers are at a high risk of being involved in an accident. If the accident is the direct result of poor safety at the site, the injured construction worker could have a personal injury claim against the owner. Although a construction worker injured while working could be entitled to file an Illinois workers’ compensation claim, he or she might also be entitled to file a personal injury claim.
  • Medical MalpracticeWhenever a medical professional fails to act in a manner that another medical professional would have done, given the same set of circumstances, medical malpractice may have occurred. It is important that you have an extremely experienced attorney by your side, as medical malpractice claims are very complex.
  • Nursing Home Abuse ClaimsShould you find your elderly loved one has suffered abuse in a nursing home, it is likely you are heartbroken, and unsure of where to turn. Having an experienced nursing home abuse attorney in your corner can help you prove the abuse, and even allow your elderly loved one to receive compensation for the abuse. While compensation can never change what happened, it could help you find a safer place for your loved one to live.
  • Workers’ Compensation ClaimsIf you were injured at work but are having a difficult time collecting workers’ compensation benefits, having an attorney by your side can help you through the process.
  • Police Brutality ClaimsPolice brutality is one of several forms of misconduct that involves undue violence by police officers. Police brutality is the use of excessive and/or unnecessary force by the police when dealing with civilians.
