Handling Prescription Drug Charges In Chicago, Illinois – Series Recap
This is the last post in my series on defending against prescription drug crimes in Chicago, Illinois. I covered reasons to take prescription drug charges seriously, related charges which you may be unaware of, as well as search and seizure issues which impact prescription drug cases. In summary, if you are charged with crimes involving prescription drugs then you may face very serious penalties. You may also face charges regarding any excessive or falsified prescriptions.
If any evidence suggests that you possessed the drugs intending to sell or distribute them, or even if you gave them away, you can face additional penalties for possession with intent to sell. There are exponential penalties for selling or giving drugs to children or pregnant women. The punishment for these crimes in Chicago can be severe. The Assistant State’s Attorney (ASA) will take into consideration your criminal history, the amount of drugs you possessed. and whether or not they can demonstrate you possessed it for sale or distribution.
Giving away drugs is distribution. It may seem benign to give a pill or two to a friend or family member but it can lead to very serious charges. There may be defenses to these charges. One option we discussed is a Motion to Suppress Evidence based on unlawful search and seizure. This is a very fact specific motion that involves testimony from police, and possibly other witnesses.
